The former groundskeeper was awarded $289 million in compensatory and punitive damages ”“ punitive damages are not meant to compensate for damages but to punish the liable party and help prevent others from engaging in similar conduct.

This was the first Roundup lawsuit to go to trial ”“ thousands of lawsuits have been filed by victims and loved ones alleging the weed killer gave them cancer. Monsanto has continued to deny these claims and seeks to appeal this latest verdict.

How Does the Roundup Weed Killer Work?

Roundup weed killer is a popular herbicide manufactured by the agricultural giant Monsanto. It was first introduced into the market in 1974 and is commonly used by farmers, landscapers and homeowners alike on lawns, gardens and fields.

The active ingredient in Roundup is glyphosate, a broad-spectrum and non-selective herbicide designed to be toxic to plants. It kills most plants it comes in contact with right down to the root. Glyphosate can also be found in many other herbicides.

Roundup weed killer is applied by spraying the product onto the leaves. Glyphosate works its way through the plant destroying any unwanted weeds. It takes between 10 to 30 minutes for the treated area to dry. The majority of Roundup products deliver visible results in several hours.

Roundup Cancer Risks

Several studies and thousands of lawsuits that have been filed have linked use of Roundup with serious health complications, including an increased risk of developing cancer, such as:

  • Burkitt lymphoma
  • B-cell lymphoma
  • Mantle cell lymphoma
  • Follicular lymphoma
  • Marginal zone b-cell lymphoma

One of the most common forms of cancer linked to Roundup is non-Hodgkin’s lymphoma, also referred to as NHL. It is a type of cancer that starts in the white blood cells in the body’s immune system. When the body produces too many of these cells, cancerous tumors start to develop and spread. People diagnosed with this disease often develop cancerous white blood cells in their lymph nodes, but it can spread to other parts of the lymphatic system including the lymphatic vessels, tonsils, spleen and bone marrow.

Common symptoms of NHL and other types of cancer linked to Roundup may include:

  • Swollen lymph nodes
  • Belly pain or swelling
  • Fever
  • Night sweats
  • Unexplained weight loss
  • Chronic fatigue
  • Chest pain
  • Trouble breathing

If you experience any of these symptoms, seek medical treatment right away. If you have cancer, you want to begin treating it as soon as possible because it may be easier to treat in the early stages. A qualified medical professional can review your symptoms and work to determine what is going on and what treatments to use.

If you do have cancer, treatment can painful, debilitating and invasive. You may need to go through procedures such as chemotherapy, radiation treatment, immunotherapy and stem-cell transplants. These treatments can be very expensive and cause tremendous pain and suffering. They can also make it difficult to work to support yourself and your family.

This is why if you have been exposed to Roundup and you think it may have caused you to develop cancer, it is in your best interest to seek legal representation as soon as possible. Consult a defective product lawyer attorney at our firm to discuss your case during a free consultation. You may be entitled to compensation through filing a Roundup lawsuit. This could not only cover current medical expenses and other damages, but also damages you suffer in the future.

What Are The Potential Health Risks Associated With Glyphosate Exposure?

Non-Hodgkin’s lymphoma is the most common disease associated with prolonged Roundup exposure. Most plaintiffs in Roundup lawsuits have been diagnosed with non-Hodgkin’s lymphoma.

Roundup and other glyphosate herbicides have been linked to additional cancers including B-cell lymphoma, leukemia, and multiple myeloma. Anyone who has documented exposure to these chemicals and a cancer diagnosis, including one other than non-Hodgkin’s lymphoma, should speak with a Roundup cancer attorney about their legal options.

Recent studies have linked glyphosate exposure to numerous complications, including:

  • Low birth weight among the children of farm workers
  • Neurological problems in mice
  • Fertility issues in humans
  • Liver and kidney disease in animals

Studies on the Risks of Roundup

Monsanto points to various studies that show no link between Roundup and cancer, including studies funded by the company itself. However, there are many other studies that have linked the weed killer to serious health issues like cancer.

March 1999

According to a study published in the American Cancer Society journal Cancer, there is an increased risk for non-Hodgkin’s lymphoma among people exposed to herbicides and fungicides.

July 2008

The International Journal of Cancer published a similar study nearly a decade later. Glyphosate, the active ingredient in Roundup, was associated with a significant increase in the risk of developing lymphoma.

May 2015

In 2015, the World Health Organization’s International Agency for Research on Cancer (IARC) issued a warning about the potential link between Roundup and cancer. The data collected by a group of cancer researchers cited the active ingredient glyphosate as being probably carcinogenic or cancer-causing to people. The agency based this finding on numerous studies of exposure to this chemical among human beings.

October 2017

Looking at the long-term effects of Roundup, a study published in The Journal of the American Medical Association (JAMA) found that the average levels of glyphosate in older adults’ urine increased between 1993 and 2016. Samples were taken from older adult farmers living in Southern California between 1993 and 2016 who were in direct contact with the herbicide. The study also found that genetically modified crops contained glyphosate when they were harvested.

Roundup Lawsuits That Have Been Filed

The $289 million verdict in the case of the former school groundskeeper could open the floodgates for many more lawsuits over Roundup weed killer products.

Thousands of Roundup lawsuits have been filed against Monsanto by people who have suffered serious health consequences, including cancer patients and their families. These lawsuits make various allegations against Monsanto:

  • The company exposed people to Roundup’s active ingredient glyphosate, and this can cause cancer
  • Monsanto knew that exposure to glyphosate presented severe health risks
  • Monsanto failed to warn consumers about the risks of cancer from using Roundup products
  • Misrepresenting Roundup’s health and environmental risks, including taking steps to cover up the lack of safety and effectiveness of the product

Monsanto continues to fight against these lawsuits and other allegations, claiming their product is harmless for people to use.

If you or a loved one has been exposed to Roundup and has developed cancer like non-Hodgkin’s lymphoma, you may be entitled to receive various forms of compensation for your suffering.

Have There Been Any Significant Settlements or Verdicts in Roundup Cancer Lawsuits?

Numerous settlements and verdicts have been reached, while many cases remain in litigation, and attorneys specializing in Roundup cancer cases continue to file new lawsuits .

Several significant jury verdicts have favored plaintiffs. In January 2024, a jury awarded one plaintiff $2 billion in punitive damages. Additionally, a Pennsylvania jury returned a $175 million verdict, and a California man received a $289 million settlement.

In November 2024, Monsanto won a jury case in Philadelphia. However, the case was considered relatively weak since the plaintiff could only document 10 uses of Roundup.

While large verdicts are possible, they are not common. Judges often reduce exceptionally large jury awards, and defendants typically appeal them. During the appeals process, both parties may negotiate a settlement for an amount lower than the original verdict.

What Evidence Is Needed To Support a Roundup Cancer Lawsuit?

To file a successful claim, an injured person must be able to prove they were exposed to Roundup or similar glyphosate-based products. Plaintiffs should be able to demonstrate at least 150 hours of exposure. Those who used Roundup extensively at home can establish exposure through proof such as purchase receipts and empty or partially used containers. An experienced Roundup cancer lawyer can help plaintiffs establish a solid case.

For work-related exposure, it is necessary to prove that the employer used Roundup and that the individual was responsible for applying it. Many plaintiffs in Roundup cases have worked as farm laborers, greenskeepers, landscapers, gardeners, or in similar professions.

Medical records must confirm a diagnosis of non-Hodgkin’s lymphoma by a licensed medical professional. Individuals diagnosed with another form of cancer can consult with the attorneys at Phillips Law Group to determine their eligibility to join the lawsuits.

How Long Do I Have To File a Roundup Cancer Lawsuit?

The timeframe for filing a Roundup lawsuit varies by state. Most states have a two- or three-year limit for filing personal injury claims, while some require filing within just one year. In other states, the deadline can be as long as six years.

Most states have a version of the discovery rule, which delays the start of the statute of limitations until the injured person becomes aware of the harm. For example, if someone is diagnosed with cancer four years after their last exposure to Roundup and their state has a two-year statute of limitations, they might be unable to file a lawsuit. However, if the state has a discovery rule, the two-year period would begin on the date of diagnosis rather than the last exposure.

Some states have laws called statutes of repose that limit lawsuit filings after a certain number of years have passed. For instance, in the previous example, if a state has a five-year statute of repose, a plaintiff would need to file a lawsuit within one year of a cancer diagnosis.

The interaction between different legal time limits can be complex and confusing. A skilled attorney can review the law in an individual’s state and determine if a Roundup cancer lawsuit is viable based on that person’s specific circumstances.

Do I Need To Have a Cancer Diagnosis To File a Lawsuit Against Roundup?

Yes. At this time, the multidistrict litigation involves only plaintiffs with cancer diagnoses.
