PCB Contamination Lawsuits

PCBs, or polychlorinated biphenyls, are a group of man-made organic chemicals consisting of carbon, hydrogen, and chlorine atoms, according to the United States Environmental Protection Agency. They were domestically manufactured from 1929 on, until manufacturing was banned in 1979, and were widely used in electrical equipment, insulation, and industrial processes. Now, PCB contamination lawsuits against Monsanto and other companies are emerging because the chemicals are linked to cancer and other adverse health effects.

PCB Contamination and Health Issues

PCBs persist in the environment, contaminating soil, water, and air, and posing significant health risks to individuals who are exposed. According to the EPA, “PCBs do not readily break down once in the environment. They can remain for long periods cycling between air, water, and soil. PCBs can be carried long distances and have been found in snow and sea water in areas far from where they were released into the environment. As a consequence, they are found all over the world.”

Unfortunately, long-term PCB exposure has been linked to serious health issues, including cancer, immune system disorders, and reproductive problems.

Specifically, the United States Agency for Toxic Substances and Disease Registry notes that, in animal studies, “commercial PCBs elicit a broad range of toxic responses,” such as:

  • Acute lethality
  • Body weight loss
  • Carcinogenesis
  • Dermal toxicity
  • Fatty liver
  • Genotoxicity
  • Hepatomegaly
  • Immunosuppressive effects
  • Neurotoxicity
  • Porphyria
  • Reproductive and developmental toxicity
  • Thymic atrophy
  • Thyroid hormone-level alterations

The agency reported that potential negative human health effects of low-level environmental exposure to PCBs “are complex and still need further validation.”

However, in some studies, types of cancer and skin conditions in humans have been linked to exposure to large amounts of PCBs.

Pursuing a PCB Contamination Lawsuit

Over time, Monsanto and other companies sold PCBs for use in numerous products. Monsanto, specifically, allegedly knew of the dangers of PCB contamination for many years but continued to claim they were not toxic.

If Monsanto or other companies didn’t take appropriate measures to prevent environmental and public health risks from PCB contamination, they may be able to be held responsible and be subject to lawsuits from affected individuals and communities. Victims of PCB exposure may face significant medical costs, lost income, and long-term health challenges, and lawsuits can help them seek justice and compensation for medical expenses, property damage, lost wages, and pain and suffering.

Individuals and communities harmed by PCB contamination have legal options. Phillips Law Group may be able to help.
