After Aziyo Biologics, Inc. announced a recall of its viable bone matrix products, more attention was drawn to bone graft contamination issues linked to the medical devices. Specifically, post-surgical Mycobacterium tuberculosis (MTB) infections were found in patients treated with viable bone matrix products. Tuberculosis can lead to life-threatening conditions and the need for prolonged medical treatment. If you or a loved one used a viable bone matrix product, particularly if it was a ViBone viable bone matrix device, you may have legal options. Recall of Viable Bone Matrix Products
In July 2023, Aziyo Biologics, Inc. announced a voluntary recall of its viable bone matrix products after two patients treated with viable bone matrix products from a single donor lot experienced post-surgical Mycobacterium tuberculosis infections. These products are bone repair devices made from human tissue used mainly in orthopedic and spinal procedures.
“We are taking immediate action to safeguard patients by implementing a full product recall as we work with the CDC to investigate this event,” Dr. Randy Mills, President and Chief Executive Officer of Aziyo Biologics, said at the time.
“The people of Aziyo care deeply about the patients we serve and will continue to work with the medical community, patients, and regulatory authorities as we gather additional information.”
Although that recall happened in 2023, in a 2024 lawsuit, Elutia, Inc. (formerly known as Aziyo Biologics, Inc.,) and DCI Donor Services, Inc. d/b/a Tennessee Donor Services were sued after the plaintiff in that case claimed that the use of ViBone led to tuberculosis infection. If you or a loved one has contracted tuberculosis after a procedure involving ViBone or other similar products, you may be eligible for compensation with the help of our skilled lawyers.
What Is Tuberculosis?
Tuberculosis is a dangerous bacterial infection that can spread through the body and cause severe health complications, especially when introduced through contaminated medical products like bone grafts.
The Mayo Clinic reported that tuberculosis is a serious illness that mainly affects the lungs. It can spread easily when people gather in crowds.
“People with HIV/AIDS and other people with weakened immune systems have a higher risk of catching tuberculosis than people with typical immune systems,” the medical center noted.
“Drugs called antibiotics can treat tuberculosis. But some forms of the bacteria no longer respond well to treatments.”
ViBone and Bone Repair Device Claims
It is concerning that even after a recall of viable bone matrix products, another individual alleged they contracted TB after using a ViBone medical product. The manufacturers of medical products are responsible for ensuring the safety and sterility of their products before they are used in patients. Failing to do so can result in devastating consequences for patients who trust these products during their surgeries.
The experienced personal injury attorneys at Phillips Law Group have a history of success in dealing with cases involving defective medical products and the team is dedicated to holding negligent manufacturers accountable for harm caused to patients. We may be able to help you pursue a legal claim involving these products.
We are committed to helping you recover compensation for medical expenses, lost wages, long-term health complications, and other damages that stem from the use of potentially dangerous medical devices, including viable bone matrix medical products.
