What Is A Traumatic Brain Injury?
A traumatic brain injury (TBI) is a type of head injury that causes a disruption to the function of the brain. Commonly, there are two forms of brain injuries:
Closed Head Injuries
These types on TBI’s are usually the result of a blow to the head of the victim or as a result of the head being shaken in a violent motion. The motion can be so severe that the brain is knocked against the inside of the skull. The side effects of a closed-head injury can result in life-long psychological and cognitive impairment.
Some causes of closed head injuries can include automotive crashes, workplace injuries, slip and falls, and sports-related incidents.
Open Head Injuries
Also known as penetrating injuries, open head injuries occur when the skull is penetrated by an exterior object with great force.
Victims that suffer open head injuries caused by an object traveling a high velocity tend to have a higher fatality rate compared to those that suffer an open head injury due to a low-velocity impact.
When determining the extent of a traumatic brain injury, medical facilities will commonly use CT scans and/or x-rays in an effort to identify the extent of the damage. MRI’s can also be used, however, any embedded objects in the brain must not be made of metal due to the magnetism used by the MRI machine.
Symptoms of A Traumatic Brain Injury
There are three classifications of traumatic brain injuries, including:
Mild Traumatic Brain Injury
Mild traumatic brain injuries commonly result in the victim being unconscious for less than half an hour. A concussion is an example of a mild TBI. Symptoms of a mild TBI may include:
- Nausea
- Vomiting
- Blurred vision
- Mood changes
- Memory loss
- Sensitivity to light
- Fatigue
- Loss of sleep
Despite being referred to as a “mild” injury, these types of injuries can still pose a significant threat to the wellbeing of the victim.
Moderate Traumatic Brain Injury
When a victim passes out and loses consciousness after an initial head trauma, this may be classified as a “moderate” traumatic brain injury. Symptoms may include:
- Slurred speech
- Weakness in fingers and toes
- Fluid from ears and nose
- Agitated mood
- Headaches
- Seizures
- Convulsions
- Repeated vomiting
Victims may also have a feeling of confusion, with symptoms appearing anywhere from hours to days after the incident.
Severe Traumatic Brain Injury
Head injuries that are classified as “severe” tend to result in the victim being unconscious for extended periods of time, with the potential for the victim to sustain a serious, life-long brain injury.
Common symptoms of an individual suffering from a severe traumatic brain injury include:
- Tinnitus (ringing in the ears)
- Unable to balance
- Having seizures
- Blurred vision
- Dilated pupils
- Difficulty speaking
- Difficulty walking
- Nausea

Is There A Time Limit to File A TBI Case In Arizona?
Yes. In Arizona, there is a two year statute of limitations for personal injury claims. This means that the plaintiff must file the lawsuit no later than two years after the date the incident occurred.
However, there can be instances that may permit this deadline to be extended or shortened.
For example, under the “Discovery Rule”, a plaintiff may have the deadline extended as they were not aware that they were injured until a period of time after the incident.
Another example may be if the victim was under the age of 18 years old when they suffered a brain injury. In that instance, the victim may be eligible to wait until he/she turns 18 years old, before the two-year deadline applies.
