Am I Eligible to Pursue Financial Compensation?

Not every traumatic brain injury (TBI) is alike. Each injury is unique and can cause changes that affect victims for a period of time, or permanently. This is why we recommend that you consult with a licensed Tucson traumatic brain injury attorney from our firm. You may be eligible to pursue compensation, but we will not know until our attorneys can review your particular circumstances.

To have a legal claim for compensation, you must be able to prove that your injury was the result of another person’s negligent actions. We have experience helping victims establish the following elements of negligence:

  • Duty of care ”“ The other party owed you a duty of care to ensure reasonable measures were taken to prevent you from suffering harm.
  • Breach of duty ”“ The other party failed to maintain this duty of care by not acting as a reasonable person would have done under a similar situation.
  • Causation ”“ The other party’s breach of duty directly caused your injury and it would not have happened otherwise.
  • Damages ”“ The other party’s breach of duty caused you to suffer actual damages, such as medical expenses to treat your injury and loss of income from being unable to work.

How Much is My Case Worth?

The worth of your legal claim will be dependent on various factors. This includes the type of injuries suffered, the medical treatments you have had and those you will need in the future, as well as your projected recovery time.

These are just some of the factors involved. An experienced attorney can help answer this question in greater detail. Generally, traumatic brain injury victims may be eligible to recover several different damages, such as:

  • Medical expenses for past, current and future medical treatments
  • Prescription medications
  • Surgery or imaging tests
  • Medical assistive devices
  • Physical therapy services
  • Loss of wages or employment benefits
  • Loss of future earning capacity
  • Pain and suffering
  • Mental anguish
  • Diminished quality of life
  • Loss of companionship

Other damages that could be recoverable but are more difficult to calculate because they have no specified monetary value include:

  • Pain and suffering
  • Mental anguish
  • Diminished quality of life
  • Loss of companionship

Can a Traumatic Brain Injury Lawyer Help Me?

Soon after an injury, expect the insurance company from the other party to contact you. They will try to get you to make statements about your version of events, ask you to record your statement, tell you that you have to provide a signature to give them access to your medical records, or even entice you to accept a quick settlement for your damages claim.

While these actions may imply that the insurance company has your best interests in mind, it could not be further from the truth. The reality is that they are a business and will do everything they can to save money. Insurers are searching to use anything you may say or do to avoid paying out fair compensation for your damages claim.

For these reasons, we recommend that you seek legal representation as soon as possible. A traumatic brain injury lawyer has the legal knowledge and resources to pursue maximum compensation for injury victims.

Our firm has nearly three decades of experience representing more than 155,000 clients in Pima County and across the state of Arizona. We understand how insurance companies think and the tactics they try to use on many traumatic brain injury victims. The legal process can be challenging and take a long time to resolve, which is why we are prepared to handle it on your behalf so that you can focus on your recovery.

We also have access to medical experts with the ability to testify to the extent and severity of your injury and contact any witnesses who may have seen the accident and could offer a favorable perspective.

Is There a Time Limit To File My Case?

Personal injury cases, including those involving traumatic brain injuries, need to be filed within Arizona’s statute of limitations. Victims in most instances typically have within two years from the date of the accident to take legal action for a traumatic brain injury caused by negligence. Failure to file before the two-year deadline could result in the court dismissing your case and being unable to recover compensation.

However, every case is different. The time limit may be extended or even shortened depending on your particular situation. For a victim who suffered an injury as a minor, the two-year deadline will not start until he or she turns 18 years old. The clock may also not begin until the date you discovered, or should have reasonably discovered, that you had suffered a traumatic brain injury.

There are certain requirements that must be followed in these instances, which can be explained further by a lawyer at our firm.

Different Types of Traumatic Brain Injuries

A traumatic brain injury or TBI occurs when a violent blow, bump or jolt causes damage to the brain. There are two major forms of brain injuries: open and closed.

  • Open head injuries ”“ These injuries happen when an object strikes a victim’s head and ends up breaking the skull and penetrating the brain.
  • Closed head injuries ”“ These injuries happen during an impact with the victim’s head and an object, but the skull is not broken.

Both open and closed head injuries can be quite harmful, exposing the victim to different types of brain trauma. This includes:

  • Concussions
  • Contusions
  • Coup-contrecoup injuries
  • Diffuse axonal injuries
  • Penetrating injuries

There are also three levels of traumatic brain injuries:

Mild Traumatic Brain Injury

A mild TBI occurs when a victim loses consciousness for a brief period of time, typically a few seconds or minutes. In other instances, the victim may not lose consciousness at all, appearing simply dazed or confused. Imaging tests of the brain may even appear normal. These injuries are only diagnosed when there is a change in the mental status at the time of the injury.

Moderate Traumatic Brain Injury

A moderate TBI usually occurs when a victim suffers a non-penetrating blow or violent shake to the head, causing a loss of consciousness for several minutes or hours. The victim may also experience a period of confusion for days or weeks. Physical, cognitive or behavioral impairments could be lasting or permanent.

Severe Brain Injury

A severe TBI usually occurs when a victim suffers a crushing blow or penetrating injury to the head, causing brain tissue damage. These injuries can cause irreversible harm or even death.

Common Signs and Symptoms of a Traumatic Brain Injury

It is generally a wise decision to seek medical attention right away after experiencing any of the following common signs and symptoms of a traumatic brain injury:

  • Changed or decreased level of consciousness
  • Slurred speech
  • Convulsions or seizures
  • Nausea and vomiting
  • Dilated pupils or double vision
  • Clear liquid drainage from the nose or ears
  • Weakness in the arms, legs or face
  • Loss of balance

In some instances, victims may not be immediately aware that they have suffered a brain injury. It could take days or weeks for any signs or symptoms to appear. However, not seeing a doctor or delaying treatment after an accident often results in a prolonged recovery, which can turn into a more serious health complication.
