Is There a Case?
One of the main questions that must be answered when trying to determine if there is a case is: did the tread belt separate from the tire because of a defective design or manufacture?
Generally, your attorney must consult an expert to test the tire and find out why it blew. Our attorneys have access to industry experts who can provide detailed information about the cause of your accident.
We recommend contacting us quickly so we can determine if you may have grounds for a compensation claim. If we find you may have a case, you decide if you want to move forward.
The initial consultation is always free.
What is My Case Worth?
You may be eligible for compensation for the costs of your medical treatment, damage to your vehicle, lost wages, pain and suffering, and potentially other damages.
However, there are many factors affecting the value of these damages, from the severity of your injuries, to the length of treatment, and the daily pain you experience.
This is why you should strongly consider talking to a Yuma defective tire lawyer from Phillips Law Group for a free consultation. We know how to determine the full value of a claim.
We are here to answer your legal questions.
Benefits of Hiring a Lawyer
Hiring a lawyer can help you protect your claim from insurance companies looking to devalue or deny it. Your lawyer can also handle the complex task of investigating the accident and gathering evidence to help build a robust case.
The investigation may include:
- Studying the tire to find broken belts or cables
- Trying to find indications of tire separation
- Determining if there were problems with the inner wall of the tire
- Reviewing the valve stem assembly
- Reviewing the area where the tire separated
Our attorneys also have access to industry experts to help us review evidence and build a strong case.
We can talk to the insurance company on your behalf and keep you informed throughout the process.

Who Is Liable for the Blowout?
The tire manufacturer could be held liable for your injuries, if you can prove negligence contributed to the blowout. The manufacturer could have been negligent in the design of the tire or when assembling it.
If there was a problem with the design of the tire, your attorney may be able to pursue a claim using the legal theory of strict liability. Your attorney would need to prove three things:
- The tire had a dangerous defect
- The defect caused the tire to fail, resulting in injury or property damage
- The tire was not altered when it was sold
You can discuss this issue with one of our Yuma defective tire lawyers in a free legal consultation.
What Is a Tire Blowout and Why Does it Happen?
A tire blowout occurs when a tire suddenly loses air at rapid speed. This can result in the tire ripping apart, making a vehicle much harder to control.
There are many reasons this could happen, including:
- Crash with another car
- Failure of the sidewall
- Fracture of the bead
- Tread separation
- Underinflation of the tire
- Over inflation of the tire
- Puncture in the tire
Drivers are responsible for maintaining their tires, including replacing old tires and keeping them at the proper inflation level. If the accident resulted from something the driver should have taken care of, he or she may not have a case.
You should inspect your tires before getting in your vehicle to make sure there are no signs of damage. You should also have your vehicle serviced regularly.
What to do if a Blowout Occurs?
A blowout can put you at increased risk for an accident. Your vehicle may become much more difficult to control, as it pulls toward the blown tire.
However, if it happens to you, there are a few best practices to help reduce your risk of an accident and safely get your vehicle out of the flow of traffic.
- Grip the wheel firmly to try to keep your car from pulling toward the blown tire
- Use your turn signal to alert other drivers that you are switching lanes
- Move toward the side of the road away from traffic
- Avoid slamming the brakes, apply them slowly
- Once you get to a full stop, use your parking brake
Once you come to a stop, turn off the car and flip on the hazard lights to alert other drivers that your vehicle is stopped.
If it is safe to do so, get out and take pictures of the tire and any damage you see on your vehicle. If you can, replace the tire with the spare. You can also request roadside assistance from your insurance company.
If you suffer any injuries, call emergency personnel so your injuries can be treated. Even minor injuries should be treated by a medical professional. While providing treatment, they may discover more serious injuries. You do not want injuries to worsen from lack of treatment. Quick treatment also helps to link your injuries to the accident.

I have been with Phillips Law Group for a little over a year and I have learned what teamwork and family in a workplace looks like. There is always someone around to lend a helping hand, which is something I appreciate and cherish. I feel a sense of joy coming to work every day because of my co-workers as well as being able to help people in what can be a scary and stressful situation. I currently work as a Litigation Legal Assistant with an amazing team. When I started here, I was not very knowledgeable in personal injury. I was lucky to have been placed with an amazing team who was willing to take time to teach and pass on some great skills that have been a huge aid in helping me be successful in my position. I would recommend working here at Phillips Law Group, because they care about their employees and there is so much room for growth.
Sophia H. at Phillips Law Group has been an absolute joy to work with -quick, responsive, and professional in every interaction. Her breadth of knowledge, from administration to IT to finance, is nothing short of impressive.
Thank you Phillips Law Group for all the support and back to school assistance we appreciate it.
Great company and awesome service. Thanks Caroline fabos. Kudos to all.
I’ve been working at Phillips Law Group for nearly four years and I can confidently say this is the best personal injury firm in Arizona to work for. The firm is the best for numerous reasons but to start, Phillips Law Group gives employees opportunities for promotions and growth. I started working within the settlement department, moved to a paralegal assistant and grew to be a pre-litigation paralegal with my own case load. Each attorney I have worked for is extremely knowledgeable, friendly, and easy to talk to. Secondly, I love how Phillips Law shows appreciation for employees. They host Friday Zoom Huddles giving out PTO, goodie bags, special shout outs, bonuses and gift cards. They also host extravagant holiday parties and fun contests during the Holidays! Lastly, the firm cares about giving back to the community, which is a trait I value as well. It’s rewarding to see a fast paced firm taking time out of their busy day to pay it forward. I would highly recommend working at Phillips Law Group!
Liz was great
Kathy Hudson and Donato Giovanatto. Continues to go above and beyond the call of duty. Reaching out to the insurance company about the damage to the vehicle. Forcing them to take responsibility.
