Giles County School Board Sex Abuse Lawsuit Involving a Minor with Autism

Spread the love

A minor identified as A N has filed a lawsuit against the Giles County School Board and individual defendants. A N is a nonverbal child with severe autism who was allegedly sexually groomed, abused, and harassed by older students while riding a school bus.

The filing states that the school district failed to protect the child even though prior warning signs and safety issues were known. The lawsuit claims the district was deliberately indifferent to the safety of a vulnerable student who required heightened supervision.

Schools Have a Legal Duty to Protect Students

Public schools must take reasonable steps to supervise children, prevent foreseeable harm, and respond to reports of danger or misconduct. This duty is especially strong for students who are nonverbal, autistic, or who cannot advocate for themselves.

Schools may be held legally responsible when:

• Staff ignore or fail to investigate reports of abuse
• Safety concerns are dismissed or not addressed
• Disabled students are not properly supervised
• Known dangers are allowed to continue
• Injuries occur due to negligence or inadequate training

Who May Qualify for a School Negligence Claim?

A student or family may qualify if

• A child with special needs was harmed on a school bus or campus
• Reports of bullying, harassment, or abuse went unanswered
• The school failed to develop or follow a safety plan
• The child experienced physical, emotional, or developmental harm
• The school failed to protect a vulnerable or nonverbal student

Parents do not need proof of intent. Negligence alone may be enough.

Compensation May Be Available

Families may be able to pursue compensation for

• Medical and therapy expenses
• Long term care or support services
• Emotional trauma
• Educational disruption
• Future needs related to disability and recovery
