Arizona Revised Statute §11-1025 includes strict liability laws that permit victims of an unprovoked dog bite attack to recover compensation for injuries without having to prove that a dog owner was negligent. It is important to note that Arizona categorizes dog bites as a personal injury, so there are no set caps on damages if you have a case. Damages, in general, fall into two categories:

• Economic damages ”“ These are easily quantifiable damages that are the direct result of the injuries you sustained, such as the costs of related medical treatments and recovery of lost wages if you were unable to work while your wounds were healing.
• Non-economic damages ”“ Less tangible damages that are not easily calculated by a concrete value may also be awarded and could include pain and suffering, mental anguish, scarring or disfigurement, loss of consortium or loss of enjoyment of life.

How Long Do I Have to File a Dog Bite Claim?

Arizona has a statute of limitations, or filing deadline, that provides victims two years from the date of the accident to file a damages claim. However, there are several exceptions to that general rule that may require victims to file significantly sooner.

How Does Arizona Define A Dog As Dangerous?

Arizona does not ban or consider any specific breed of dogs as high-risk. However, state law does define a dog as dangerous if it has previously attacked or bitten a person or domestic animal without provocation.

Additionally, every dog in the state that is over the age of three months must be licensed as well as a have a certificate bearing proof of up-to-date vaccinations signed by an accredited veterinarian.

Dogs that have previously bitten should already be on record. If the attacking dog is not documented, it will be placed into quarantine for 10 full days from the date of the attack. If the exact date is not known, then it will be confined for 10 days from when it is first discovered.
