If you or a loved one received an Encore Metal-on-Metal Hip Implant, you may be entitled to compensation due to device failure, severe pain, metallosis (metal poisoning), the need for revision surgery, and more. These defective implants have been linked to serious complications, leading to lawsuits against Encore Medical for negligence, failure to warn, and defective design.
Phillips Law Group is investigating cases of defective Encore metal hip implants and has more than 30 years of experience with proven results, including cases involving defective implants and other medical devices. Please contact us today if you or a loved one wants to discuss your legal options.
Encore’s metal-on-metal (MoM) hip replacements were marketed as durable and long-lasting, but many patients suffered from any number of the following issues:
In 2019, the United States Food and Drug Administration noted that “Metal-on-metal (MoM) hip implants have unique risks in addition to the general risks of all hip implants.”
“The sliding metal surfaces will cause some tiny metal particles to wear off of the device into the space around the implant,” the agency noted. “Wear and corrosion at the connection between the metal ball and taper of the stem may also occur. Some of the metal ions (e.g. cobalt and chromium) from the metal implant or from the metal particles will enter the bloodstream.”
“Orthopaedic surgeons take several precautions before and during hip replacement surgery to try to optimize the way in which the ball and socket rub against each other so that fewer wear particles are produced. However, there is no way to fully avoid the production of metal ions and some metal particles,” the FDA warned.
If your Encore hip implant failed or caused complications, you may have grounds for a product liability lawsuit. Manufacturers may be held accountable for defective design or manufacturing, failure to warn patients and doctors of risks, misleading marketing claims, and more.
Victims may be able to secure settlements to cover medical bills, lost wages, pain and suffering, and future care needs.
