The Adult Survivors Act (ASA), signed into law by New York State Governor Kathy Hochul in May 2022, created a lookback window from November 24, 2022, to November 24, 2023. This enabled sexual abuse victims to file a civil suit even if the statute of limitations for their claim had previously expired. Albion Correctional Facility was one of several women’s prisons named as co-defendants in lawsuits filed during this period, many of which centered around sexual assaults committed by guards employed during the 2000s and 2010s.

Although the lookback period has expired, a 2019 amendment to state law has granted adult victims of sexual abuse up to 20 years to file suit, provided the harm occurred after the amended law went into effect. If you were assaulted in prison in 2019 or more recently, contact Phillips Law Group for advice. This dedicated team of attorneys has experience proactively pursuing Albion Correctional Facility sexual abuse lawsuits and can help with your claim.

A History of Abuse at the Correctional Facility

Located just outside the village of Albion, about 30 miles west of the Rochester city limits, the Albion Correctional Facility site has been in use since 1894, first as the Western House of Refuge for Women and then as the Albion State Training School. In 2015, Albion Correctional Facility was involved in a lawsuit over a sexual assault committed in 2007 by a guard against an inmate at the facility. The Civil Court of Claims ruled in this case that facility management knew of their employee’s unlawful actions but failed to do anything to stop them.

Litigation and investigations in the intervening years have revealed further abuses by Albion employees and supervisor neglect. Just over 43 percent of female inmates interviewed by the Correctional Association of New York in 2022 reported witnessing or experiencing physical abuse, verbal harassment, and/or sexual assault while incarcerated at Albion.

Who Could Hold Civil Liability for Prison Abuse?

In addition to the individual employee(s) of Albion Correctional Facility who committed sexual assault, facility management and ownership may hold civil liability for this misconduct. Depending on the circumstances, this could entail holding management accountable for their failure to properly screen, train, and supervise the employees they hired, intentional efforts to hide employee misconduct, or intimidating inmates to prevent them from reporting abuse.

However, the unique rules applicable to civil lawsuits against government entities and the facilities they own and operate can make those lawsuits procedurally different from claims filed solely against private individuals.
