What Must Be Proven in a Wrongful Death Case?

Most wrongful death cases are filed on grounds of negligence. To establish negligence, you must prove the following four legal elements:

1. There was a duty of care. You must be able to show that the party who caused your loved one’s death owed some legal duty to your loved one. For example, if the at-fault party was a health care provider who was treating your loved one, the legal duty is to act in accordance with the accepted standard of care. If the at-fault party was a driver, his or her legal duty was to obey traffic rules and act in a reasonable manner to prevent the injury or death of others.
