New York City Sexual Abuse Lookback Window

In January 2026, the New York City Council passed critical legislation expanding the Gender-Motivated Violence Act (GMVA). This update gives survivors of sexual abuse more time to file civil lawsuits, including claims against institutions and government entities that enabled or failed to prevent abuse.

This new law creates a limited New York City sexual abuse lookback window, reopening legal options that were previously blocked by court rulings. For many survivors, this may be the final opportunity to pursue justice.

Who Qualifies for the New York City Lookback Window?

You may be eligible to file a sexual abuse lawsuit if:

  • The abuse occurred in New York City on or before January 9, 2022
  • You were previously barred by the statute of limitations
  • Your prior lawsuit was dismissed due to limitations in the earlier GMVA language

A new lookback window will be open from March 2026 through March 2027. During this time:

  • Survivors may file new civil sexual abuse claims, even if the abuse happened decades ago
  • Survivors who filed lawsuits between March 2023 and March 2025 may be able to amend or refile dismissed claims
  • Claims may be brought against individuals, institutions, and government agencies

Once this window closes, time-barred claims may be permanently barred again.

Why New York City Expanded the GMVA

The updated law follows a 2025 court decision that dismissed more than 450 sexual abuse lawsuits filed against city-run juvenile detention centers. The court ruled that the earlier version of the GMVA only allowed lawsuits against individual perpetrators, not the institutions responsible for supervision and protection.

Although the GMVA was amended in January 2022 to clarify that institutions could be sued, courts ruled the change did not apply retroactively. As a result, survivors abused before January 9, 2022 were left without legal recourse.

To address this gap, New York City passed Intro. 1297, which:

  • Reopens the statute of limitations for certain sexual abuse claims
  • Explicitly allows lawsuits against institutions, agencies, and other entities that enabled abuse
  • Allows previously dismissed cases to be amended or refiled during the new lookback window

The bill was sponsored by Selvena Brooks-Powers and supported by a broad majority of the City Council.
