Do I Have a Case?

Cases that involve workplace amputation accidents are highly unique and each are different from one another. Many factors are considered in order to determine if you are eligible to file a claim for compensation. Due to the particular circumstances involving your injury, it is essential that you contact an experienced Yuma amputation lawyer to see whether or not you may pursue legal action.

In these types of cases, we typically need to prove that your employer acted negligently, and there is a direct link between your injury and his or her negligence. There are four legal elements of negligence that must be proven to pursue compensation:

  • Duty of care ”“The defendant owed the victim a duty of care, which is a legal responsibility to act in a reasonable manner in order to prevent harm.
  • Breach of duty ”“ The defendant failed to fulfill the legal duty of care owed to the victim, whether by action or inaction.
  • Causation ”“ The defendant’s breach of duty of care caused the victim’s injury and there is evidence that proves their connection.
  • Damages ”“ Due to the injury, the victim suffered damages, which can be economic (medical expenses and lost wages) and/or non-economic (pain and suffering).

Employer negligence can contribute to many scenarios that lead to a workplace accident that causes an employee to suffer an amputation injury, such as:

  • Failure to properly educate employees about safety regulations
  • Failure to enforce workplace safety regulations
  • Failure to provide employees with proper safety equipment
  • Failure to train employees on the proper use of safety equipment
  • Failure to implement safety measures on a jobsite, such as installing barriers or safety netting
  • The use of unsafe equipment, such as outdated equipment without safety controls or unmaintained equipment that is dangerous for employee use
  • Forcing employees to overwork

On a federal level, employers are required to follow safety regulations imposed by the Occupational Safety and Health Administration (OSHA). OSHA dictates that employers are responsible to provide a safe workplace for employees that complies with the legal rules, regulations and standards and is free of noted safety hazards, provide safety training and tools, and more. Arizona employers must also follow the state’s Division of Occupational Safety and Health regulations.

These state and federal regulations are designed to help ensure the safety of workers, but often they are overlooked or unenforced by some employers. Ultimately, it is the workers who suffer negative impacts as a result of the employer’s negligent behavior.

Thorough investigation is needed to identify and prove employer negligence. Our licensed Yuma amputation attorneys are prepared to evaluate your claim and discuss the legal options available to you during a free and confidential consultation. There is no risk or obligation to pursue legal action.

What Is the Value of My Case?

Victims of workplace amputation accidents are often faced with significant expenses, both immediate and ongoing. The value of a case depends on many different factors, and as the circumstances are unique in every case, there is no standard value that applies to all.

To determine the value of your case, your attorney will consider the severity of your injury and its impacts on you, the expenses that have already mounted and the costs of anticipated future medical care, the actions of your employer and many more factors.

You may be able to recover the following damages for your injury:

Economic Damages for Workplace Amputations

  • Past and current medical expenses
  • Cost of future medical care that you are expected to need
  • Transportation and parking expenses for medical appointments
  • Prosthetic and/or assistive medical equipment
  • Home renovations to accommodate your disability
  • Lost wages from being unable to work
  • Lost earning capacity for future income

Non-Economic Damages for Workplace Amputations

  • Physical pain and suffering
  • Emotional pain and suffering
  • Loss of enjoyment of life
  • Disability
  • Disfigurement and scarring
  • Loss of companionship

A qualified Yuma amputation lawyer from our firm knows how to evaluate the different factors involved in each unique claim to properly determine the value of a case. These details can help us determine the fair value of the damages you have suffered in order to pursue compensation.

How Long Do I Have to Take Legal Action?

Arizona Revised Statutes 12-542 sets the statute of limitations for the majority of personal injury cases at two years. In most instances, injury victims generally have two years of the date the injury occurred to take legal action. Failure to do so within the two years means that your lawsuit may be dismissed and you could lose your opportunity to pursue compensation for your injuries.

In some cases, exceptions to the state’s statute of limitations may apply. For instance, if your legal claim is against a government entity, you have 180 days from the date your injury occurred to file. Minors who suffered an amputation have two years from the date of his or her 18th birthday to take legal action.

As different rules may apply to each case, it can be difficult to know how long you have to file a legal claim. We recommend that you get in touch with our Yuma amputation lawyers at Phillips Law Group. Your initial consultation is free and there are no upfront fees involved for our services.

What to Do After a Workplace Amputation Accident

If you suffer an accident that causes amputation at work, seek immediate medical care as this type of injury can have fatal complications. When you are able, take these important steps to guard your health and protect your legal claim:

  1. Inform your employer of the incident as soon as possible. Doing so establishes a record of the incident and links it to your injury. If you fail to take this step, the insurance company may question if your injury truly occurred while you were at work.
  2. Take photos of the accident scene, your injuries and the involved equipment. If you are unable to physically do so, ask a family member, friend, or trusted coworker to take photos for you.
  3. Attend all medical appointments and strictly obey your doctor’s orders. Doing so helps your recovery and limits the insurance company’s ability to claim that your actions prevented healing and made your condition worse.
  4. Use a journal to record details of the accident, your medical treatments and how your injury affects you on a daily basis. Write down what your recall about the accident ”“ stick to the facts and do not assume anything. Note your pain levels at various times of the day and activities you are unable to perform due to your injury.

When you work with our firm, we can help gather the necessary documents and other types of evidence needed to prove your claim. We are prepared to conduct a detailed investigation should you have a case and decide to move forward.
