What is My Claim Worth?
This is one of the issues you can discuss in a free consultation with one of the experienced attorneys at Phillips Law Group. We need to review the circumstances of your injury, how it affects your ability to work, the amount of physical pain and suffering you are experiencing and other factors.
There are various types of compensation we may be able to pursue in an injury claim, starting with the cost of past and future medical treatment for your injury. This could include out-of-pocket costs for stays at the hospital, prescription medications, surgical procedures, physical therapy, and appointments with doctors. Medical bills often make up a large percentage of damages from an injury accident.
Other damages you may be able to pursue include:
- Lost wages for times you missed work
- Lost earning capacity because of a permanent disability
- Property damage, such as damage to your vehicle in an auto accident
- Physical pain
- Emotional suffering
- Lost enjoyment of life when you cannot take part in activities you once enjoyed because of your injuries
- Loss of companionship
- Punitive damages
One of the advantages to hiring our Avondale personal injury lawyers is their extensive experience in calculating the accurate value of a claim. At Phillips Law Group, we know how to thoroughly investigate an accident to gather evidence, establish the damages suffered and determine what they are worth.

Do I Have a Valid Claim for Compensation?
It is difficult to make this determination on your own. You should strongly consider meeting with a licensed attorney to review whether you have a valid case. Generally, your attorney must be able to establish the four elements of negligence were present in your accident: duty of care, breach of duty of care, causal link to injuries and damages. Unless we can prove all four elements, there is no case.
Essentially, the central issue is whether the breach of a duty of care can be linked directly to an injury that resulted in damages, like medical bills and lost wages. A duty of care is a legal obligation to act the way a reasonable person would in a similar situation, as this should help prevent others from being harmed. If the duty is breached, you must show it directly caused an injury.
The duty of care is specific to each case. For example, in a car accident case, the at-fault driver may have breached a duty of care to follow the speed limit or not tailgate another car.
If you have questions about whether you may have a case, calling a lawyer can be an important step. There is no risk or cost to contact Phillips Law Group, and you can get answers to your legal questions.
We take on many kinds of personal injury cases, including those involving:
- Truck crashes
- Car accidents
- Workplace injuries
- Medical malpractice
- Defective product injuries
- Dog attacks
- Construction accidents
- Slip and fall accidents
- Wrongful death
- Motorcycle crashes
What if I am Partially at Fault for My Injury?
You can still seek compensation for your damages, but your amount of compensation may be reduced in proportion to the percentage of fault you are assigned for the accident. This is done according to Arizona’s comparative negligence system.
You can learn more about how this may apply to your claim by contacting Phillips Law Group for a free, no-obligation legal consultation.
Benefits of Hiring an Avondale Personal Injury Attorney
Insurance companies, at-fault parties and their attorneys protect their best interests, not yours. They actively work to avoid paying fair compensation for your damages and to avoid accountability for the harm you have suffered.
This is one of the most important reasons to consider hiring a licensed attorney to represent you. The attorneys at our firm understand how difficult it can be to recover from an injury caused by another’s negligence. We are committed to aggressively pursuing maximum compensation for your injuries, so you have the money you need to try to make the best recovery possible.
If we take your case, we are prepared to deal with the insurance company on your behalf, so you do not have to. This includes negotiating for compensation and preparing your case for trial in case the insurance company does not offer fair compensation.
We can consult industry experts to help build a strong argument on your behalf, obtain video footage of the accident, take steps to preserve evidence, and other measures that may help your claim.

What is the Deadline for Taking Legal Action?
The short answer is two years from the date of the accident, according to Arizona’s personal injury statute of limitations. Those who attempt to file after the deadline passes will likely see their claims dismissed in court.
However, while this is the standard deadline, there may be exceptions. In some cases, the deadline is sooner or later, based on state laws. For example, you must provide notice of a claim against a government entity within 180 days of the accident.
The two-year clock will not start to run for minors until they hit 18 years of age. If you are declared to be of unsound mind, the clock on the statute of limitations will not run during this period.
The deadline for your claim is something you can discuss with an experienced Avondale personal injury attorney.
What Should I Say to the Insurance Company if They Call?
You have the option of referring the insurance company to your attorney. If you talk to them, be cautious and stick to basic facts. Providing too many details about the accident or your injuries may innocently give the insurance information to use against you to deny your claim or as a reason to offer a very small amount of compensation.
Insurance adjusters are trained to be friendly. This may give you a false sense of security and cause you to say something that hurts your claim. Typically these are statements of common polite conversation, such as, “I feel OK,” or “It could have been worse.” These types of comments could very easily work against you as you and your attorney pursue injury compensation.
If the adjuster asks you to give a recorded statement, you need to know you are not required to do so. You should seriously consider discussing these requests with your attorney.
While you may be tempted to accept a settlement offered early in the process, these offers are often for much less than the full value of a claim. Once your treatment ends, our attorneys can get a better idea of your ongoing requirements for treatments, as well as the effect of your injuries on your future earning capacity.

Liability for a Personal Injury
There are many parties that could potentially be held liable for your injuries, including other drivers, truck drivers, property owners, dog owners, nursing homes, staff at nursing homes, bus drivers, product manufacturers, doctors and other health care providers, and government entities.
Phillips Law Group has the resources to launch an in-depth investigation to determine who may be at fault for your injuries and the accident that caused them.
What Should You do After Being Injured in an Accident?
Victims should seek medical treatment, and if possible, collect evidence at the scene (pictures, statements from witnesses, notes on what they remember about the accident, etc.).
Medical treatment is the first priority because you need to stabilize your injuries to help prevent them from worsening. Immediate treatment also helps to link your injuries to the accident ”“ establishing this link is critical in building a robust case against the at-fault party.
Pictures can be very powerful evidence in an injury claim, particularly pictures of your injuries, the specific location where the accident occurred, property damages and other relevant details.
Filing an official report about the accident is another important step that can help to validate your claim. After a motor vehicle accident, call the police so they can come to investigate and file a police report.
Continuing your medical treatment is critical to the value of your claim. If you stop, the other side may argue you are not really hurt or are not as badly hurt as you or your attorney claim. This may result in the other side offering a lowball settlement.
