How Much Is My Case Worth?
Determining if you have a scooter accident case and if so, the value of that case can be difficult without knowing the full details about the specific incident. However, we understand that as an injury victim, you may be unable to work or have bills from medical treatment that need to be paid and consequently, you may have questions about your potential case.
At Phillips Law Group, we can help to provide answers to those questions. By completing our “Free Case Evaluation” form or by calling our firm for your free consultation, we can begin to obtain some of the information about your incident and determine if you have grounds to file a claim.
How Can Hiring A Scooter Accident Lawyer Help Me?
When an accident lawyer handles a case, the victim usually receives more compensation compared to those that do not use a lawyer.
In Arizona, accident victims have two years to file their lawsuit…
In Arizona, most injury lawsuits need to be filed within 2 years after the accident. However, there may be certain circumstances that extend this deadline OR bring it forward.
Under the “Discovery Rule”, plaintiffs may be eligible for an extension if they are able to prove that they were not aware that they were injured until after the event took place. For example, a scooter rider that was hit from behind by another vehicle may not have a sore neck at the time of the incident however, a few days later, they may have significant pain from the whiplash caused in the crash.
A reputable lawyer may help to identify this information and incorporate it into your potential lawsuit.
Dealing with Insurance Companies
Following a collision, insurance companies may also become involved in proceedings. Many injury victims are not aware that any statements and/or signed documents that are given to the insurance company may be used against the victim in an effort to discredit their claim.
Experience has shown us that insurance companies are only interested in settling the claim as quickly as possible, for little or no financial outlay. Their primary obligation is to shareholders – not to injury victims and their families. Having a lawyer on your side can help to ensure that your interests are being protected. By acting as your representative, we can handle all of the inquiries from the insurance companies so that you can focus on the recovery process.

Rules and Regulations For Scooters In Arizona
As motorized and electric scooters are still gaining in popularity, there are not as many regulations as some other vehicles. However currently, motor-driven scooter riders are required to have:
- A motorcycle license
- Insurance
- Registration
… and can be ridden on roads only (not on bike paths).
Electric bikes and E-Scooters have some different regulations including:
- No license required
- No insurance required
- No registration required
- No title required
- Can be used on roads and bike paths
- Must weigh under 75 pounds
- Maximum speed cannot exceed 25 mph
By contrast, mopeds may be considered a type of motorcycle. If so, laws applicable to riders would likely apply to a scooter accident.
For a moped to be considered a motorcycle it must:
- Reach a maximum speed of 25 mph on flat ground
- Have pedals
- Have two or three wheels
- Have an engine capacity of 50cc or less
- Have 1.5 bhp or less
Minimum insurance coverage is the same as other motor vehicles, with $10,000 for property damage liability coverage per accident, $15,000 for bodily injury liability coverage per person and $30,000 per accident.
Who Can Be Held Liable in A Scooter Crash?
When building a scooter accident lawsuit, it must be established that negligence was involved in the collision. That negligence may come from different sources including:
- The Rider – if a rider has collided with another vehicle, person or property and caused damage, they may be liable. The rider may have been distracted while using a cell phone and riding, which may have contributed to that person losing control of the vehicle that they were responsible for controlling.
- Other Motorists – if a driver collides with a scooter, that driver may be liable. There can be many causes of motor-vehicle related accidents which can be determined during the investigation of your claim. As required by Arizona law, motorists must have minimum insurance coverage on their vehicle. This is where compensation may be recovered from initially.
- Pedestrians – people that walk, run, fall or jump in front of a moving scooter may also be liable for a crash. If so, the pedestrian may have homeowner or renter’s insurance, which may be able to be claimed against.
- Manufacturers – in the event that a design or manufacturing defect caused or contributed to a crash, the manufacturer (or other parties associated with the design, building, shipping, handling, selling) of the vehicle may be liable.
- Local Government – should excessively dangerous road conditions (potholes, unmarked roads) contribute or cause a collision, the government body responsible for road maintenance may be liable for damages.
Depending on the damages associated with the crash, victims may be eligible to obtain compensation for various expenses that may be related to incident:
- Past medical expenses
- Future medical expenses
- Medication costs
- Rehabilitation costs
- Lost income
- Loss of future income
- Loss of earning potential
- Pain and suffering
