A minor known as Y A R has filed a lawsuit against the Los Angeles Unified School District for disability based bullying, physical assault, negligent hiring and supervision, and violations of federal disability discrimination laws.
According to the filing, the student reported ongoing harassment and safety concerns at Ramon C Cortines School of Visual and Performing Arts. Despite these reports, the school allegedly failed to take meaningful action. The minor was later violently assaulted by another student, causing injuries and long lasting emotional distress.
Federal law requires schools to prevent and address harassment when it targets a student because of a disability. This includes:
• Section 504 of the Rehabilitation Act
• The Americans with Disabilities Act
• The Individuals With Disabilities Education Act
Schools must implement accommodations, respond to reports of danger, and protect students from foreseeable harm.
A child or family may qualify if:
• A student with disabilities experienced bullying or assault
• The school ignored repeated complaints
• Safety plans were not created or followed
• Staff failed to supervise or intervene
• The student suffered physical or emotional injury
These cases often involve failures in supervision, failures to act, or systemic neglect of disabled students.
Families may be able to seek compensation for:
• Medical care
• Therapy and psychological support
• Pain and suffering
• Educational losses
• Costs of future care
• Injuries caused by discrimination or neglect
