Definition of a Traumatic Brain Injury

When brain function is disrupted by a blow to the head, the victim has suffered a traumatic brain injury. While there are many different brain injury diagnoses, they are generally classified as one of two kinds of injuries:

Closed Head Injuries

When the blow to the head does not penetrate the skull, or the head is shaken so much that it causes injury, it is called a closed head injury. In severe cases, the brain is knocked against the skull, causing lifelong cognitive problems.

Open Head Injuries

If the skull is pierced with an object, it can cause the brain to bleed and do significant damage. Individuals who suffer these injuries often have a higher fatality rate than those who suffer closed head injuries.

One of the problems with attempting to diagnose the damage done by an open head injury is that the object that pierced the skull may be metal. If that is the case, the victim cannot go into an MRI machine because the magnets in the MRI machine would pull on the object.

Signs of a Brain Injury

When a person suffers from a traumatic brain injury, it is not always obvious. They may feel fine at first and then begin to suffer different symptoms. Some of the symptoms and signs of a traumatic brain injury include:

  • Dizziness
  • Loss of consciousness
  • Confusion
  • Sudden aggressive behavior
  • Anxiety
  • Insomnia
  • Sudden speech issues
  • Difficulty seeing clearly
  • Random and painful migraines
  • Loss of memory
  • Lost sleep
  • Fatigue
  • Nausea
  • Trouble walking
  • Seizures
  • Tinnitus

These are some signs to be aware of after getting into an accident or being attacked by someone. When experiencing even just one of these symptoms, it is important to get checked out at the hospital for possible brain injuries. Medical professionals can perform different tests and scans to find out what is going on.

The more severe the symptoms, the more likely you have a severe brain injury. However, if left untreated, it is possible a minor brain injury could get much worse.

Can I Recover Compensation for My Brain Injury?

You may be able to recover compensation for your traumatic brain injury if you can prove that you sustained the injury because of another’s negligence. Your attorney must prove four elements to establish negligence:

  • Duty of care ”“ This means there was a legal duty to act with reasonable care to prevent injury to someone else. For example, doctors have an obligation to provide care that is consistent with accepted medical standards.
  • Breach of duty of care ”“ This means the at-fault party did not act reasonably, as the duty of care required him or her to do.
  • Link to damages ”“ In other words, your injuries would not have happened without negligence occurring.
  • Existence of damages ”“ You need proof of damages from your injuries, like medical bills, documentation of pain and suffering, employment records, etc.

What is the Statute of Limitations for My Case?

In Arizona, you generally only have two years from the date of the accident to file a personal injury claim against the liable party.

It is important to note there can be exceptions to this two-year deadline. The discovery rule says the two-year clock on a claim does not start until the date the victim discovers the injury or should have discovered it.

There are also exceptions for claims against the government and minors, which can be discussed with one of our experienced Yuma traumatic brain injury lawyers.

You can also benefit from referring insurance companies to us so we can communicate with them. Insurance companies like to try to trick accident victims, knowing they are vulnerable because of their injuries and financial issues created by the situation. One of the most important things you can do to protect your claim is to refer the insurance company to your attorney to help avoid being manipulated by them.

Our firm has dealt with many insurance companies and we are prepared for their tricks. We know how to protect a claim and negotiate for fair compensation. We have obtained more than $1 billion over 27 years.

What Causes a Traumatic Brain Injury?

Traumatic brain injuries are usually the result of a blow to the head, which can occur in many situations:

  • Car accidents – The force of impact of one car hitting another can jolt a person forward, causing that person to hit their head against the airbag, windshield, or even the ceiling of the vehicle.
  • Fights/attacks ”“ The fight could be part of a crime or something that happens because people are under the influence of alcohol. Someone could get hit in the head in the fight or even fall and suffer a brain injury. During the fall, the victim could hit his or her head on a sharp object that could pierce the skull, resulting in a brain bleed.
  • Slip and fall accidents If someone slips and hits his or her head hard on the floor or on any other object, it can cause internal bleeding and other injuries.
