- Suspected Christmas Morning Phoenix DUI Accident Kills One Pedestrian, Seriously Injures Another | Legal News | News Ticker
Pedestrians who cross the streets in Phoenix are always taking on some level of risk, particularly when doing so during the early morning hours. However, that does not excuse the conduct of a motorist who does not obey traffic laws, particularly if that motorist has been drinking. While it’s too early to know for sure based on available information, police suspect alcohol played a role in a fatal Phoenix pedestrian accident that occurred early on Christmas morning. Police are continuing to investigate the situation.
According to authorities, the latest suspected Phoenix DUI accident occurred at approximately 2:30 a.m. on Saturday morning when two men, aged 52 and 53 respectively, were attempting to cross McDowell Road near 24th Street in Phoenix when they were struck by the driver of a Chevrolet SUV. The 34-year-old female driver’s vehicle subsequently veered out of control and smashed into a traffic light, coming to a halt. The unidentified 53-year-old man died at the scene, and the other unidentified pedestrian was listed in serious condition at a nearby hospital.
Arizona Pedestrian Accident Statistics
First and foremost, we’d like to offer our sincere condolences to the families and friends of the men who were harmed in this incident. Losing a life in this manner is always tragic, particularly on Christmas morning, and no family should ever have to receive the news that these families are about to receive. We also hope that the injured pedestrian is able to overcome his injuries. In addition, this Phoenix pedestrian accident will now become part of the overall statistics regarding Arizona pedestrian accidents. Every year, more than 1,500 such crashes occur, leading to more than 1,400 injuries and to more than 10 deaths every month.
Arizona DUI Accident Lawyers
If it’s proved that the driver had alcohol in her system, she will likely face serious criminal charges. In addition, she could face an Arizona wrongful death lawsuit filed by the family of the pedestrian who was killed and an Arizona personal injury lawsuit filed by the pedestrian who was injured. If these claims are filed and are successful, they could lead to damages awards that compensate the plaintiffs for their losses, including medical costs, lost income, pain and suffering and loss of companionship.
