Am I Eligible for Workers’ Compensation?
Arizona employers must carry workers’ compensation insurance for any full or part-time regularly employed individual. This rule does not apply to:
- Independent contractors
- Occasional employees
- In-home domestic workers

What Types of Compensation Could I Receive?
If your workers’ compensation claim is approved, your benefits may cover related medical expenses as well as a portion of the wages you lost while recovering from your injuries. Temporary benefit payments continue for your recovery period while permanent benefit payments may continue if your injury causes you permanent disability.
Types of workers’ compensation benefits include:
- Temporary Partial Disability (TPD): While recovering, employees may work limited hours, but it may not be the same type of work or level of pay as in their original role. TPD payments equal two-thirds of the wage difference from before the accident to the reduced present amount.
- Temporary Total Disability (TTD): TTD benefits start one week after an injury is sustained and continue through the medical treatment period. Monthly benefits are paid at two-thirds of what a person was making monthly in the 30 days prior to the accident.
- Permanent Partial Disability (PPD): Once the worker reaches the maximum medical improvement, TPD benefits stop. If the treating physician determines the employee is able to return to work, but not in the same role as performed prior to the injury, PPD benefits begin. These benefits equal half the former monthly salary.
- Permanent Total Disability (PTD): If a worker is disabled and unable to ever go back to work, PTD payments are issued weekly up to the maximum allowable benefit.
- Death Benefits: If a worker is killed on the job, death benefits help pay for funeral and burial costs. Benefits are equal to 67 percent of the worker’s average monthly wage, and maximum monthly amounts depend on the date of injury. Death benefits may be paid to surviving spouses, children under 18, children under 22 enrolled in school full time or surviving children who are unable to support themselves.

How Long Do I Have to File for Workers’ Compensation Benefits?
The Industrial Commission of Arizona (ICA) requires you to report any job-related injuries to your employer as soon as possible. It is highly recommended that you do this before leaving the jobsite on the day of your accident. This helps to ensure your injury is documented when it happens and lessens the possibility of your employer claiming you got hurt elsewhere.

Two family members were in a bad wreck a couple of years ago, and as a result called Phillips Law to represent them.
