Sexual Abuse Definition
Whenever someone was involved in non-consensual sexual behavior, he or she was a victim of sexual abuse. This often happens with an authority figure, such as a spiritual leader, coach, family member or teacher.
Victims often include people who are already vulnerable, such as children, the elderly or people with disabilities. Unfortunately, the abuse can happen many times over a prolonged period. If the abuse is for a shorter period time and is more forceful, it is often considered sexual assault.

Do I Have a Valid Case?
This is difficult to answer until we have had a chance to thoroughly review what happened and the damages you have suffered. Generally, those who have been victims of any of the following may be eligible to pursue a claim for compensation:
- Forced sexual activity (vaginal, anal or oral penetration, whether from a body part or object)
- Forced sexual activity for money
- Incestuous sexual activity
- Touching of genitals
- Denial of contraception or protection from sexually transmitted diseases
- Sexual exploitation by a therapist
- Exposure to child pornography
Another factor to consider when trying to determine if you have a case is liability. While the perpetrator may be the only one liable, there could be other parties that may have some liability. This could include institutions like schools or medical facilities. Our attorneys would need to prove administrators and other authority figures ignored warning signs of abuse or failed to take prompt action to help protect the victim.
We know these are very difficult situations to handle. This is why the consultation with our attorneys is confidential and free of charge. We want you to be well-informed about your possible legal options.
What is a Sexual Abuse Case Worth?
Sexual abuse is a devastating betrayal by people who are supposed to be protecting those who are vulnerable. It can affect victims in a variety of ways, physical, emotionally and psychologically.
This is why you may be eligible to pursue a variety of damages for the effects of sexual abuse. This could include compensation for the following:
Medical Bills
The injuries from abuse may need extensive medical treatment. This can be especially true for young children who are victims of abuse. Medical expenses could include the cost of hospitalization, medical tests, surgery and prescription medication.
Lost Wages and Earning Capacity
The psychological damage from abuse can lead to depression and other problems that could keep victims from returning to work. Victims may also struggle to continue working in the same capacity as they did before. For example, they may need to work fewer hours or in a different job.
Counseling
If you need psychological treatment or talking therapy, you may be able to obtain reimbursement for these costs.
As each case is unique, it is best to discuss your damages with a qualified attorney. Phillips Law Group’s Flagstaff sexual abuse lawyers can review the damages that may be available to you in a free consultation.
What is the Time Limit for Filing a Claim?
If you want to pursue personal injury damages, there is a limited time to do so. Arizona’s personal injury statute of limitations is two years from the date of the injury. Generally, victims who fail to file a claim within that time lose the right to do so.
There can be exceptions to this general rule though, depending on the specific circumstances of your claim. This is why it is important to discuss your claim with a licensed attorney as soon as possible. He or she can determine how much time you may have left to file a claim.
In May 2019, a new law took effect in Arizona stating minors can file a sexual abuse claim within 12 years of their 18th birthday.
There is limited time to take legal action. Call 1-800-706-3000 today
What are the Different Types of Sexual Abuse Cases?
Some of the most common examples of sexual abuse cases include instances of abuse by the following authority figures:
Priests and Other Clergy Members
Abuse by these figures can go on for a long time, as churches often protect them, providing more opportunity for them to abuse young people.
Coaches and Teachers
We place a lot of trust in teachers and coaches, and sometimes that trust is taken advantage of. Oftentimes, coaches are some of the most influential people in a young person’s life.
Doctors at Universities
Students trust doctors to care for their health and well-being and that can be exploited for the purpose of committing sexual abuse.
Nursing Home Staff Members
The elderly are particularly vulnerable to abuse because of their physical and mental limitations. This is particularly true for nursing home residents, who may be afraid or unable to report abuse.

How Damaging is Sexual Abuse?
Victims of sexual abuse often suffer from various psychological problems, including:
- Post-traumatic stress ”“ This can include flashbacks, where victims relive their experience. There can also be heightened anxiety in certain situations.
- Anxiety ”“ This can include panic attacks, stressful thoughts and chronic fear of those who remind victims of their abusers.
- Depression ”“ Victims may struggle to want to get out of bed in the morning. They may have a lack of energy and feel sad often. There can also be trouble concentrating.
Unfortunately, many victims turn to drugs and alcohol to help them cope with their depression and other issues caused by the abuse they suffered. In other cases, victims may feel suicidal, develop eating disorders, struggle with their relationships and engage in self harm.
Possible Signs of Sexual Abuse
There are many signs of sexual abuse to watch for among friends, coworkers and family members, such as:

I want to thank attorneys Tim and Robert and the paralegal Bethany for all they had done on my case. They were all empathetic, knowledgeable and professional. All my questions were answered, emails returned in a timely matter, and promises fulfilled. I recommend Phillips Law Group if you need help with your injury case.

Two family members were in a bad wreck a couple of years ago, and as a result called Phillips Law to represent them. Montana Thompson was the attorney assigned to the case with the help of Nemo Farr as legal assistant. Mr. Thompson litigated a very generous settlement for both my stepdaughter and her son. Because my grandson is a minor, I decided to act as conservator for him to ensure the settlement was safe and secure. Montana helped with that process, but it was Nemo who went way above and beyond the call in finding a financial institution to use for the restricted account. There were some glitches in that process but Nemo helped navigate them with a calm expertise which belies his age. I would consider them both great representatives of the level of commitment to their clients and assets to their firm.

Phillips Law Group is a company that has taught me so many things. It’s an Honor and a Privilege to work for a company that cares about its employees and clients for 12 years. I’ve seen Management go out of their way to help someone whether it’s a personal matter or work related. I am also reminded of many occasions where a Client needed urgent help and we as a Team were able to get the person immediate assistance. At Phillips Law we make that happen through Teamwork and a dedication to our profession. I’ve had numerous jobs in several other fields, those were just jobs. This is a home. Many of us have been here for quite a few years, it feels like one large extended family.
