Staffing agency Hire Dynamics L.L.C. is being accused of retaliating against an employee by the Equal Employment Opportunity Commission. The worker had filed a discrimination charge against the company.
The EEOC described the situation Tuesday, saying that the staffing and professional recruiting firm, based in Duluth, GA, had assigned the position of quality auditor (for one of the firm’s clients) to an unidentified employee. The employee missed one day of work and was suspended for a week.
The unnamed employee filed a discrimination charge against the company, prompting the EEOC to file a lawsuit. In the suit, the agency claims that the employee was no longer given any new assignments or opportunities by Hire Dynamics, L.L.C.after filing the charge against the company.
According to the EEOC, these actions violate Title VII of the Civil Rights Act of 1964.
EEOC District Director Bernice Williams Kimbrough said in a statement, “an employer has no right to punish him for exercising his rights… In today’s employment climate, the importance of protecting workers who utilize the charge filing process is greater than ever.”
Retaliation charges filed with the EEOC have been recently increasing. If something similar has happened to you, contact a Phoenix employment lawyer from Phillips Law Groupat 602-222-222 .
