Lorsban Lawsuit | Chlorpyrifos | Phillips Law Group
In August 2021, the Environmental Protection Agency (EPA) published a regulation to ban the use of chlorpyrifos on food, starting in early 2022. Exposure to this chemical, which is used in many popular insecticides like Lorsban, Dursban, and Cobalt, has been linked to severe neurological damage in children five years old and younger. This includes an increased risk of autism, cognitive impairments, and learning disabilities. Lawsuits involving these chemicals, including Lorsban lawsuits, have resulted from this link being discovered.
If your child has been diagnosed with autism or another neurological disorder (epilepsy, attention-deficit/hyperactivity disorder, cognitive impairments), give Phillips Law Group a call today to discuss potential legal options and a possible Lorsban lawsuit.

How Do I Know if I May Have a Case?
You can contact our firm to schedule a free consultation so you can discuss this question with one of our licensed attorneys.
There are various factors we likely need to consider as we try to answer this question, particularly your child’s diagnosis and the details about his or her exposure to Lorsban. For example, we likely need to know how and for how long your child was exposed to this toxic substance.
Who is at Risk?
Chlorpyrifos is the active ingredient in several insecticides, including:
Children five years old and younger, including children who have not yet been born, and who lived near crop fields that were regularly treated with chlorpyrifos may be at high risk for neurological injury. Chlorpyrifos is the active ingredient in Lorsban products.
The first study that linked chlorpyrifos to developmental harm in children was published all the way back in 2003. Researchers discovered higher levels of chlorpyrifos metabolite (created when the body tries to break down the pesticide) in umbilical cord blood had a strong association with smaller infant birth weight and length.
There were other studies published between 2006 and 2014 showing those same infants suffered from developmental delays. They also had lower scores on standardized tests of development.
Three recent studies on prenatal exposure to chlorpyrifos that were published in 2017 and 2018 helped confirm health concerns about chlorpyrifos. These studies were done on rats and researchers found these substances resulted in decreased learning, hyperactivity, and anxiety.
Research by the Environmental Protection Agency (EPA) has found prenatal exposure to chlorpyrifos may be the direct cause of neurological injuries to children that are diagnosed after birth.
The University of California, Davis came out with a study in 2014 that revealed pregnant women who lived near crops sprayed with chlorpyrifos and other organophosphates had a 60 percent higher risk of having a child who would be diagnosed with autism.
Despite research on the dangers of chlorpyrifos, and the ban on indoor use of this substance in 2000, it was still used extensively over the page 20-plus years. Millions of pounds of chlorpyrifos are sprayed on more than 50 crops each year in the U.S. (The EPA says this insecticide is one of the most used in the country.) This includes:
California and Hawaii have already banned chlorpyrifos. California ended sales of the substance to California growers as of February 6, 2020. New York is in the process of phasing it out. Maryland has restricted the use of this chemical as well. The European Union and Health Canada have already banned almost all uses of chlorpyrifos.
Chlorpyrifos is often sprayed by trucks and from the air near neighborhoods. The wind can carry this toxic substance into nearby homes and businesses. Typically, children who live in farming, agricultural, or ranch communities are at the highest risk for exposure.
If your child has been diagnosed with autism, learning disabilities, or other neurological issues, and you have lived near crop fields that were regularly treated with chlorpyrifos, you may have a case. The risk of exposure may be even higher for children and pregnant spouses of those who worked with chlorpyrifos.
Damages in a Lorsban Chlorpyrifos Child Injury Lawsuit
If one of our attorneys reviews your claim and determines you may have a valid case, we are prepared to pursue full compensation for damages resulting from your child’s injuries. This includes past and future medical bills, pain and suffering, and other damages.
Medical expenses include things like:
- Testing (X-rays, MRIs, CT scans, blood tests, etc.)
- Occupational therapy
- Behavioral therapy
- Appointments with doctors
- Mental health counseling
- Physical therapy
- And more
Children with neurological and cognitive impairment may also need tutoring or instruction at a private school, which can quickly become very costly.
In some cases, you may be able to pursue compensation for the effect of an injury on a child’s ability to earn a living in the future. This could be considered a lost future income.
Non-economic damages may also be available. This could include things like lost enjoyment of life and emotional anguish. This may include the emotional anguish parents deal with when their child has a neurological/cognitive impairment.
At Phillips Law Group, we have the resources to launch a thorough investigation of your case to determine the damages that were suffered and their value. We have been assisting injury victims for more than 28 years and have extensive knowledge of how to calculate a victim’s damages. We are also prepared to bring in experts to help evaluate injuries and project how those injuries may impact a victim’s life.
Importance of Contacting an Attorney for a Lorsban Lawsuit
Victims of defective products often ask themselves why the manufacturer put consumers at risk. While the answer to this question may be complex, one factor may be that corporations have a lot of financial resources to throw at consumer lawsuits. They often bring in multiple attorneys to attempt to avoid financial responsibility for the damages their products cause.
In other words, corporations may put consumers at risk because they believe they can manage lawsuits to their advantage.
This is one reason why you need experienced legal representation if you hope to secure favorable compensation for damages. You need a law firm with the resources to investigate a defective product case and the legal knowledge to build a strong case.
Phillips Law Group has been assisting injury victims for nearly three decades and has obtained more than $1 billion in compensation. Founding Partner Jeffrey Phillips often works with other attorneys around the nation on defective product cases. He is also a member of the National Trial Lawyers Association Top 100.
Our firm is prepared to manage every step of the legal process, including the investigation, reviewing medical records, working with experts, and negotiating favorable compensation. We are committed to keeping you informed about the status of your case from beginning to end. We know how devastating a personal injury can be, especially when the victim is a child.
There is no risk in working with us as there are no fees to pay upfront. We do not get paid until the end of the legal process, and only if we obtain compensation.

Why Lorsban is Dangerous?
The active ingredient in Lorsban is designed to quickly kill insects by attacking their nervous systems. The chemical works by blocking an enzyme controlling messages that travel between nerve cells, which prevents the nervous system from functioning, eventually killing the insect.
Chlorpyrifos affects children in much the same way. Once it enters the body, the body tries to break it down and creates chlorpyrifos oxon, which permanently binds to enzymes controlling messages that travel between nerve cells. If this compound enters the nervous system, it can stay there for a long time.
Being exposed to a small amount of chlorpyrifos may cause symptoms such as:
- Runny nose
Significant exposure to chlorpyrifos may result in severe symptoms like:
- Muscle tremors
- Muscle weakness
- Loss of coordination
- Blurry vision
Chlorpyrifos may also cause injuries like:
- Bipolar disorder
- Personality disorder
- Cerebral palsy
- Atypical Parkinsonisms
- Essential Tremor
- Lewy Body Dementia
