- Another Fatality Results from a Phoenix Pedestrian Accident | Legal News | News Ticker
Walking in traffic at night is always a dangerous activity, especially when not using a crosswalk. However, motorists are still expected to use caution when driving, particularly when visibility is low during the evening. Tragically, a man was killed last night in a Phoenix pedestrian accident when he attempted to cross a street outside of a crosswalk and was hit by a passing motorist. Police are continuing to investigate the situation, and for now no arrests have been made and no citations have been issued.
According to police, the second fatal Phoenix pedestrian accident occurred at approximately 10 p.m. last night when 59-year-old Roger Dale Rose was attempting to cross East Indian School Road at 30th Street when he was hit by a vehicle moving in a westbound direction. Reports indicate that the man was about 50 yards outside of the crosswalk, and the area was dimly lit. The man was rushed to a nearby hospital by rescue personnel, but he was unable to survive his injuries. The name of the driver involved was not released.
Arizona Pedestrian Accident Statistics
First and foremost, we’d like to offer our sincere condolences to the family and friends of the man who was killed. Losing a life in such a random and violent manner is always a tragedy. In addition, this Phoenix pedestrian accident will now become part of the overall statistics regarding Arizona pedestrian accidents. Every year, more than 1,500 such crashes occur, leading to more than 1,400 injuries and to more than 120 fatalities.
Phoenix Wrongful Death Lawyers
It seems that, based on the available facts, that the pedestrian was at least partially negligent in this fatal Phoenix pedestrian accident. If that’s the case, the family of the man could still possibly file an Arizona wrongful death lawsuit, but such a claim would have to be reviewed under Arizona’s comparative negligence standard. Basically, any recovery made by the family would be reduced by the amount of negligence assigned to the man who was killed by the court.
If you have lost someone you love in an accident, you need to seek the help of Phoenix wrongful death lawyers who can review your case and help you determine how to proceed properly. Contact Phillips Law Group today to schedule a free initial consultation.
